Two of the three suspects charged with the murder of jewelry store owner Larry Davis could face the death penalty if convicted, even though the U.S. Virgin Islands does not have a death penalty law.
The third suspect could also be sentenced to death if tried as an adult, according to Saturday's Daily News.
Because the charges brought against the defendants include violation of the Hobbs Act — interfering with interstate commerce by committing a robbery that resulted in murder — the U.S. Attorney’s Office can seek the death penalty under federal law.
Hugh P. Mabe III, assistant U.S. attorney, said his office has not decided whether to seek the death penalty. The case is still under investigation.
Davis, 59, was shot at point-blank range May 8, 1998, after four masked men entered and robbed his store, the Emerald Lady, on Back Street.
Jason Hull, 23, and Irvine Hodge, 21, were charged this week with first-degree murder in the crime, as was a third man who was a minor at the time and who has not been identified. The fourth suspect has not been arrested.
